Are you wondering what’s changing with New Jersey’s condo reserve study law and how it impacts your community association?

Short Answer: New Jersey now requires most condominium associations to conduct regular reserve studies, include long-term financial plans, and comply with specific funding and disclosure rules. These changes are designed to standardize financial planning and protect owners and buyers - and if your community serves Wildwood or Cape May County, understanding these new requirements is essential for compliance and property marketability. 

 

What Is a Reserve Study and Why It Matters

reserve study is a detailed financial and physical assessment of your condominium’s common elements - from roofs and decks to elevators and community infrastructure. It estimates the remaining useful life and replacement cost of major components and helps associations plan financially for future repairs or replacements. 

Under the updated New Jersey law, these studies are no longer optional for most condominium associations - they are mandatory. 

 

The New Legal Requirements in New Jersey

1. All Condominiums Must Have a Professional Reserve Study

Under the statewide reserve study law (effective January 8, 2024), all condominium associations - including those in Wildwood, North Wildwood, Wildwood Crest, West Wildwood, Diamond Beach, and throughout Cape May County - with at least $25,000 in common area assets must conduct a professional reserve study. This study must be prepared or overseen by a qualified professional such as a licensed engineer, architect, or credentialed reserve specialist. 

2. Frequency of Updates

Your community must update its reserve study at least every five years. If your association hasn’t had a reserve study in the last five years, you were required to complete one by January 8, 2025. After that, reserve studies must be renewed at least once every five years. 

3. Required 30-Year Funding Plan

Reserve studies must include a 30-year funding projection that shows how the association plans to finance anticipated future capital repairs and replacements. The law now requires that at least one of the funding plans must allow the reserve fund balance to reach zero dollars at some point during the projection - but NEVER below zero. 

This baseline funding plan gives associations a realistic long-term financial roadmap, helping avoid surprise special assessments or deferred maintenance. 

 

Funding Options and Disclosure

Flexible Funding for Current Associations

Under the updated legislation (S3992, effective August 2025), associations can choose between:

  • Full funding of the reserve plan recommended in the study;

     or
  • Funding at 85% of the recommended plan for up to five fiscal years, with strict disclosure requirements. If your board opts for the 85% approach, you must notify all unit owners in 20-point bold font and state when a special assessment or loan might be necessary and how much it might be. Sellers must also provide this notice to buyers prior to contract execution. 

After five years using the 85% option, full compliance is required, meaning your community must shift to a fully funded baseline plan.
